The powers of the court
In accordance with Art. 36 FKZ "On Arbitration Courts in the Russian Federation" dated April 28, 1995 No. 1-FKZ, the Arbitration Court of the Chukotka Autonomous District:

  • considers in the first instance all cases subordinate to arbitration courts in the Russian Federation, with the exception of cases falling within the competence of the Supreme Court of the Russian Federation;
  • revises, due to newly discovered circumstances, judicial acts adopted by it and which have entered into force;
  • applies to the Constitutional Court of the Russian Federation with a request to verify the constitutionality of a law applied or to be applied in a case considered by it in any instance;
  • studies and summarizes judicial practice;
  • prepares proposals for improving laws and other normative legal acts;
  • analyzes judicial statistics.

The Court of Appeal is the Sixth Arbitration Court of Appeal, which is located in the city of Khabarovsk.
The Court of Cassation is the Arbitration Court of the Far Eastern District, which is located in the city of Khabarovsk.
The supervisory authority is the Supreme Court of the Russian Federation, which is located in the city of Moscow.


Arbitration courts
From November 1, 2017, the administration of arbitration requires the right to exercise the functions of a permanent arbitration institution. This right is granted to two arbitration institutions by federal law, and to other institutions it is granted by an act of the Government of the Russian Federation.
Currently, four arbitration institutions have the right to administer arbitration:

Writs of execution
A writ of execution is issued against receipt to the recoverer upon presentation of identification documents, or to the representative of the recoverer upon presentation of a power of attorney or other document confirming the authority of the person, and identity documents.
Writs of execution not issued on the appointed day are sent by registered mail with notification.

Daily, on a first-come, first-served basis:

Bankruptcy of individuals
From October 1, 2015, amendments to the Federal Law of October 26, 2002 No. 127-FZ “On Insolvency (Bankruptcy)” and certain legislative acts of the Russian Federations regulating the procedure for bankruptcy of individuals. Previously, only a legal entity could be declared bankrupt.
A citizen himself, as well as creditors and authorized bodies can file an application with the arbitration court. At the same time, the debt of a citizen must be at least 500 thousand rubles, and the delay in payments must be at least 3 months. In addition, a citizen must present evidence of his insolvency to the court.
Direct participation and control over the course of the procedure for declaring a citizen bankrupt is carried out by the financial manager, whose candidacy is approved by the arbitration court.
When considering a case of bankruptcy of a citizen, the restructuring of the citizen's debts, the sale of the citizen's property, and the settlement agreement are applied.
Debt restructuring is possible in cases where a citizen has income or in the future he will receive funds that will allow him to fulfill his obligations to creditors. In this case, the court approves the debt repayment plan, which indicates:
- the period of its implementation;
- the amount of amounts left monthly to the debtor and members of his family to ensure their livelihoods;
- the amount of amounts that are expected monthly to pay off the claims of creditors.
If it is not possible to restructure the debt, the debt of an individual who has been declared bankrupt may be repaid at the expense of his/her property.
Amicable agreement between the debtor and creditors can be concluded at any stage of the bankruptcy case, while the proceedings on the case are terminated.
It is also necessary to know about the consequences of declaring a citizen bankrupt, which significantly restrict his rights. The court may prohibit the debtor from traveling abroad until the completion of the procedure for the sale of his property. Within five years, a citizen is not entitled to assume credit obligations - information about his status will be freely available to all banks. Within three years, he is not entitled to hold a managerial position at the enterprise.
