Requisites for accounting of transactions with pledges and funds contributed by the defendants instead of the measures taken by the court to secure the claim

Based on the order of the Court Department at The Supreme Court of the Russian Federation dated 05.11.2015 No. 345 "On the approval of the regulations for organizing the activities of economic courts of republics, regional, regional courts, courts of federal cities, courts of autonomous regions and autonomous regions, district (naval) military courts, federal arbitration courts, departments of the Judicial Department in the constituent entities of the Russian Federation on working with personal (deposit) accounts for accounting transactions with funds received at a temporary disposal ", to the deposit account of the Office of the Judicial Department in the Vologda Region (hereinafter referred to as the Office) to record transactions with funds received at a temporary disposal:

1. The procedure for depositing funds into a deposit account

When depositing funds to a deposit account, the payment document must be indicated surname, first name, patronymic of the payer (name of the legal entity), case number (if any) and purpose of payment (payment of a bail, securing a claim or securing reimbursement of legal costs).
From January 1, 2021, it is necessary to indicate in the payment documents the code of the regulatory legal act that determines the grounds for the receipt, return or transfer of funds. The code of the regulatory legal act (hereinafter referred to as the NLA) is entered in field 22 “Code” of the payment order.

A copy of the payment document, according to which the funds were deposited into the deposit account of the Department, is submitted by the payer to the court for attachment to the case file.
2. The procedure for transferring funds from a deposit account
Transfer of funds from a deposit account is carried out by the financial and economic department of the Office only on the basis of a judicial act that has entered into legal force, containing an indication in the operative part of the payment of funds to the pledger, persons participating in the case, other participants in the proceedings or authorized persons at the expense of funds received at the temporary disposal of the Department, or on the return of funds to the payer.
Payment (return) of funds is carried out by the financial and economic department of the Office to the current personal (settlement) account of the recipient at his request with a copy of the passport and bank details attached.
Unclaimed funds, for which the recipient did not apply with the application, are debited from the personal account after three years from the date of entry into force of the judicial act, which resolved the case on the merits, with their subsequent transfer to the federal budget.

Requisites for payment of forensic examination

Forensic examination in the process of considering the case by the court in accordance with Art. 79 RF and Art. 283 of the Code of Criminal Procedure of the Russian Federation can be appointed if in the process of considering issues that require special knowledge in various fields of science, technology, art, craft, the court appoints an examination. The forensic examination is appointed directly by the court, the parties to the case can also petition the court for the appointment of a forensic examination, indicate the issues to be resolved in the course of the forensic examination, and also indicate a specific expert institution. The examination may be entrusted by the court to a forensic institution, a specific expert or several experts.
The procedure for reimbursing procedural costs is provided for by the Regulation on reimbursement of procedural costs associated with proceedings in a criminal case, costs in connection with the consideration of a civil case, as well as costs in connection with the fulfillment of the requirements of the Constitutional Court of the Russian Federation, approved by the resolution of the Government of the Russian Federation of 01.12 2012 № 1240.
